financing must be conducted on a DCM. Starting today, we invite all stakeholders to
work with us on providing regulatory clarity on how to list spot crypto asset contracts
on a DCM using our existing authority, as I have previously proposed since 2022.
Together, we will make America the crypto capital of the world.”
The CFTC invites all interested stakeholders to submit feedback and suggestions
on listing spot crypto asset contracts on a DCM, including section 2(c)(2)(D) of the
Commodity Exchange Act, Part 40 of CFTC regulations, and whether there are any
implications under the securities laws or regulations with respect to an SEC
framework for trading of non-security assets that are part of an investment contract.
Members of the public may provide written input by August 18 by submitting a
comment on the CFTC website. Submissions will be published on CFTC.gov. For

美國商品期貨交易委員會（CFTC）市場監管部、清算與風險部宣布，應指
定合約市場 Railbird Exchange, LLC 和衍生品清算機構 QC Clearing LLC 的請求，
兩部門決定對涉及事件合約的互換交易數據報告和記錄保存規定的事項采取不
行動立場。
根據該不行動函，兩部門將不會建議 CFTC 對上述任一實體或其參與者因未
遵守特定互換交易記錄保存的規定，或未將依據 Railbird 規則執行或受其規則約
束、并通過 QC Clearing 清算的二元期權交易及可變賠付合約交易數據報告至互
換交易報告庫的行為采取執法措施。
該不行動函僅適用于極為少數的情形，并且其性質類似于針對其他處于相似
