對 LaMarco 實(shí)施的制裁
此外，在 2025 年 6 月 20 日的一項(xiàng)命令中，法院因 LaMarco 通過訴狀和信
件對 CFTC 及其律師反復(fù)提出誹謗性和虛假指控的不當(dāng)行為而對其予以制裁。法
院反駁了 LaMarco 提交文件的部分內(nèi)容，并認(rèn)定“LaMarco 在提交的文件中不斷
提出不真實(shí)和虛假的指控”，表現(xiàn)出惡意行為。法院還認(rèn)定 LaMarco 對 CFTC
律師的威脅是“不可原諒的”。
相關(guān)刑事訴訟
在涉及 CFTC 案件中相同行為的關(guān)聯(lián)刑事訴訟中，LaMarco 早前在美國訴
LaMarco 案（案號：2:16-cr-433 (E.D.N.Y.)）中承認(rèn)了一項(xiàng)商品欺詐和一項(xiàng)電信
詐騙指控。2017 年 2 月 3 日，LaMarco 被判處 42 個月監(jiān)禁，并支付 872,600 美
元的賠償。
CFTC 提示，裁判要求對受害者的資金償還可能無法追回受害者的所有損失，
因?yàn)椴环ㄐ袨槿丝赡軟]有足夠的資金或財(cái)產(chǎn)。 CFTC 將繼續(xù)堅(jiān)定為保護(hù)客戶做出
努力，并追究不法行為人的責(zé)任。CFTC 感謝美國紐約東區(qū)檢察官辦公室在此案
